En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. This paper presents an ethical framework designed to support the development of critical data literacy for research methods courses and data training programmes in higher education. The framework we present draws upon our reviews of literature, course syllabi and existing frameworks on data ethics. For this research we reviewed 250 research methods syllabi from across the disciplines, as well as 80 syllabi from data science programmes to understand how or if data ethics was taught. We also reviewed 12 data ethics (...) frameworks drawn from different sectors. Finally, we reviewed an extensive and diverse body of literature about data practices, research ethics, data ethics and critical data literacy, in order to develop a transversal model that can be adopted across higher education. To promote and support ethical approaches to the collection and use of data, ethics training must go beyond securing informed consent to enable a critical understanding of the techno-centric environment and the intersecting hierarchies of power embedded in technology and data. By fostering ethics as a method, educators can enable research that protects vulnerable groups and empower communities. (shrink)

In this paper, I propose to analyse two objections raised by Turner Jr in his paper “On Two Reasons Christian Theologians Should Reject The Intermediate State” in order to show that the intermediate state is an incoherent theory. As we shall see, the two untoward consequences that he mentions do not imply a metaphysical or logical contradiction. Consequently, I shall defend an Intermediate State and I shall propose briefly one metaphysical conception of the human being able to reply to Turner (...) Jr’s objections. (shrink)

Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that we must (...) think of the value of epistemic states as consisting in more than simply accuracy. The debate regarding the nature of joint action has come to a stalemate due to a dependence on intuitional methods. Normativists, such as Margaret Gilbert, argue that action-relative normative relations are inherent in joint action, while non-normativists, such as Michael Bratman, claim that there are minimal cases of joint action without normative relations. In this work, we describe the first experimental examinations of these intuitions, and report the results of six studies that weigh in favor of the normativist paradigm. Guido Löhr's recent article makes several insightful and productive suggestions about how to proceed with the empirical study of collective action. However, their critique of the conclusions drawn in Gomez-Lavin & Rachar (2022) is undermined by some issues with the interpretation of the debate and paper. This discussion article clears up those issues, presents new findings from experiments developed in response to Löhr's critiques, reflects on the role of experimental research in the development and refinement of philosophical theories, and (...) adds to Löhr's suggestions about the path forward. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. From the refusal of some parents to apply some vaccines to their children, in this work we will show that to act properly it is not enough with a good intellectual justification to validate a belief as accurate, it will be necessary to take into account also the systematic actions in relation to which we are constituted, as well as the feelings that accompany those actions. We begin by exposing the notion of belief that Villoro presents from authors such as (...) Braithwaite and Bain. Next, we briefly explain the topic of the justification of beliefs and then articulate it with some of the controversies related to the application of vaccines. Later, we turned to Hume to show the role of imagination in relation to pleasure and pain in decision making. Finally, we present an outline of the discussion about paternalism in the application of vaccines. (shrink)

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. We explore solutions to mitigate the inconsistency. (shrink)

From the epistemological posture that we present in this work we sustain the following thesis:-That as subjects we constitute the world we live in through one of the possible conceptual frameworks.-Our cognitive and social practices construct the world in a certain manner, which makes us responsible for the way this world is constituted.

In this paper, I defend an epistemological pluralism that moves away from universal and absolute rationality, as well as from a radical and arbitrary relativism, where any criterion is valid for decision making. Such epistemological pluralism maintains that subjects know the world in which they live according to different conceptual schemes. We posit a notion of truth linked to the justification process and practical effectiveness. Then we present the importance of traditional knowledge in the socio-ecological field and relative to complex (...) systems. Finally, we explain the relevance of epistemic equity between traditional and scientific knowledges in order to anticipate consequences and to make decisions less uncertain. (shrink)

In this paper we discuss whether the thesis of Nietzsche’s perspectivism, from an interpretation, could be read in keys of onto-epistemological pluralism. For this, we begin by exposing Nietzsche’s questioning of the notion of rational truth, as well as the universalist and transcendental positions linked to this concept. In the second section we expose some of the main theses of American pragmatism and show that perspectivism is not close to this current of thought. Finally, we present the proposal of ontological (...) and epistemological pluralism and we refer to why Nietzsche’s perspectivism could be articulated with this position and why not. (shrink)

The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. Some arguments against David Lewis’s modal realism seek to exploit apparent inconsistencies between it and anthropic reasoning. A recent argument, in particular, seeks to exploit an inconsistency between modal realism and typicality anthropic premises, premises common in the literature on physical multiverses, to the effect that observers who are like human observers in certain respects must be typical in the relevant multiverse. Here I argue that typicality premises are not applicable to the description of Lewis’s metaphysical multiverse, where the proportions (...) of metaphysically possible observers possessing the pertinent properties can be independently established by metaphysical reasoning. However, other kinds of reasonable anthropic premises can be seen to be consistent with and usable within modal realism. (shrink)

According to a bits generation technique, that is, bits can only take a binary value of 0 in the absence of wave function collapse and 1 when wave function collapse occurs, that is, regardless of the value random in which the collapse of the wave function occurs that in the past caused the development of an alternative technique of classic bits to be renounced and remains currently an impossibility in normal science, through series of quantum entanglements, using BCD, EBCDIC or (...) ASCII coding standard in computing, data are teleported surpassing c, from a sender to a receiver, theoretically placed at any distance. This technique is a new discovery with theoretical foundation in the work “Superluminal Data Transmission supported by Quantum Entanglement” (1) by this author, stored, since April 2023, as a preprint, in the ResearchGate, and Philpapers repositories, and pending implementation by communications engineering in a longterm future. In this work it is unequivocally established that the maximum speed c for this type of transmission is false, causing critical break with Relativity. This new technique, unlike the one presented in my previous paper, it is a version much simpler that can be implemented according to the current state of technology, so at present the instantaneous transmission of information can be tested experimentally. El artículo aborda el problema de la relación entre el ser humano y la técnica en el mundo actual desde una perspectiva filosófica. Volver a la concepción de la filosofía griega permite concebir hoy el quehacer filosófico como un ejercicio vital, sin fracturas entre el pensamiento y la acción. La patente plasticidad del ser humano evidencia la constitutiva apertura que determina su especificidad y, además, columbra la estrecha vinculación entre técnica, creación y cuidado a partir del acontecimiento del habitar. El (...) cuidado no puede tener lugar sin cierta promoción de un ethos cultural centrado en el miramiento, la asistencia y la preocupación por uno mismo y por el Otro. El olvido de la relación entre la creación y el cuidado conduce a un desequilibrio ethopoiético entre la condición ontológica del ser humano, como ser nacido, finito y vulnerable, y el desarrollo tecnológico, impulsado por la digitalización de la vida y el ascendente papel de las nuevas tecnologías en la sociedad. Advertir y remediar dicho desequilibrio supone repensar la originaria relación entre la creación técnica y el cuidado ético, así como la importancia de la ética para la persistencia de lo orgánico. This essay proposes a reductive account of robust macro-regularities. On the view proposed, regularities can earn their elite scientific status by featuring in good summaries of restricted regions in the space of physical possibilities: our “modal neighborhoods.” I argue that this view vindicates “nomic foundationalism”, while doing justice to the practice of invoking physically contingent generalizations in higher-level explanations. Moreover, the view suggests an explanation for the particular significance of robust macro-regularities: we rely on summaries of our modal neighborhoods when (...) reasoning hypothetically about “agentially accessible” possibilities. Working memory is thought to be the psychological capacity that enables us to maintain or manipulate information no longer in our environment for goal-directed action. Recent work argues that working memory is not a so-called natural kind and in turn cannot explain the cognitive processes attributed to it. This paper first clarifies the scope of this earlier critique and argues for a pluralist account of working memory. Under this account, working memory is variously realized by many mechanisms that contribute to (...) the maintenance and manipulation of information across tasks. This view in effect updates one of the earliest pluralist formulations of working memory. Juxtaposing this view against deflationary descriptions allows us to delineate two gradients that help us chart various accounts of working memory and identify their respective theoretical commitments. In turn, we can isolate those accounts that fail to accord with the evidence supporting a pluralist view, and we can begin to rehabilitate working memory as a pluralist, and ultimately more informative, construct. In this chapter, we will summarize recent empirical results highlighting how different groups of people solve pure coordination games. Such games are traditionally studied in behavioural economics, where two people need to coordinate without communicating with each other. Our results suggest that coordination choices vary across groups of people, and that people can adapt flexibly to these differences in order to coordinate between groups. We propose that pure coordination games are a useful empirical platform for studying aspects of mindshaping. Drawing (...) on existing psychological literature on alignment during interactions, we suggest that experience of successful interaction leads people to develop aligned intuitions about what is relevant and appropriate that support coordination when interaction and communication is not possible. Consistent with arguments made in the literature on mindshaping we believe that such alignment is more important for coordination than mindreading inferences about mental states, and indeed that mindreading is instead a form of coordination behaviour that is dependent upon intuitive alignment. Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. Laura Specker Sullivan (2022) makes a fairly compelling case for the value of the perspectives of Buddhist practitioners in neuroethics. In this study, Tibetan Buddhist monks have been asked, among other things, whether consciousness, in brain-injured patients in a minimally conscious state, entails a duty to preserve life. In our view, some of the participants’ responses could be used to inform the bioethical debate on death determination.

En el presente texto se defenderá la idea según la cual, la filosofía y el filosofar están intrínsecamente ligados. Se partirá de un caso paradigmático, el caso de la filosofía analítica. A partir de su definición,se pretenderá mostrar que las características más sobresalientes de dicha corriente están fundamentalmente ligadas al acto de filosofar.Por medio de dicho ejemplo, se desea mostrar que enseñar la filosofía consiste en enseñar a filosofar, y que por lo tanto una no puede ser separada de la (...) otra. Aprender a filosofar es entonces, aprender a ver un problema detrás de cada página de un texto filosófico, una argumentación detrás de cada problema y finalmente, una verdad detrás de cada argumentación. El precio a pagar por dicha separación es bastante alto, se podría hablar de épocas de decadencia intelectual. (shrink)

Working memory is a foundational construct of cognitive psychology, where it is thought to be a capacity that enables us to keep information in mind and to use that information to support goal directed behavior. Philosophers have recently employed working memory to explain central cognitive processes, from consciousness to reasoning. In this paper, I show that working memory cannot meet even a minimal account of natural kindhood, as the functions of maintenance and manipulation of information that tie working memory models (...) and theories together do not have a coherent or univocal realizer in the brain. As such, working memory cannot explain central cognition. Rather, I argue that working memory merely redescribes its target phenomenon, and in doing so it obfuscates relevant distinctions amongst the many ways that brains like ours retain and transform information in the service of cognition. While this project ultimately erodes the explanatory role that working memory has played in our understanding of cognition, it simultaneously prompts us to evaluate the function of natural kinds within cognitive science, and signals the need for a productive pessimism to frame our future study of cognitive categories. This paper uses the tools of experimental philosophy to examine the nature of interpersonal normativity in collective action, focusing on cases of immoral collective action and collective action by friends. The results of our two studies, which expand on recent empirical interventions into longstanding debates in social ontology, demonstrate that according to our everyday judgments there are interpersonal obligations in cases of collective action, even when immoral, and that, while friendship elicits judgments of togetherness, it does not affect the norms (...) of collective action. We also situate these results in the philosophical literature and discuss their consequences for a “pluralism” about sociality. (shrink)

Based on the various documents, 1989-2002, through the original texts, in addition to the author's contributions, this paper presents the refutation of the mathematicians and physicists A. Logunov and M. Mestvirishvil of A. Einstein's "general relativity", from the relativistic theory of gravitation of these authors, who applying the fundamental principle of the science of physics of the conservation of the energy-momentum and using absolute differential calculus they rigorously perform their mathematical tests. It is conclusively shown that, from the Einstein-Grossman-Hilbert equations, (...) gravity is absurdly a metric field devoid of physical reality unlike all other fields in nature that are material fields, interrupting the chain of transformations between the different existing fields. Also, in Einstein's theory the proved "inertial mass" equal to gravitational mass has no physical meaning. Therefore, "general relativity" does not obey the correspondence principle with Newton's gravity. (shrink)

A. Logunov, Yu. M. Loskutov and M. A. Mestvirishvili, additionally, together with the introductions, summaries and conclusions of the author of this paper. The “Relativistic theory of gravitation” is a gauge theory, compatible with the theories of quantum physics of the electromagnetic, weak and strong forces, which defines gravity as (...) the fourth force existing in nature, as a static field equipped with the transmitter particles of the virtual gravitons of spins 2 and 0, within the spirit of Galilei's principle of relativity, in his generalization of Poincaré's Special Relativity that allowed the authors to universalize that the physical laws of nature are complied with regardless of the frames of reference where they apply, integrated into the Grossmann-Einstein Entwurf theory, in its further development, by those authors, therefore, this theory preserves the conservation laws of energy-impulse and angular impulse of the gravitational field jointly to the other material fields existing in nature, in the Riemann's effective spacetime, through its identity with Minkowski's pseudo Euclidean spacetime. The notion of a correct appreciation of nature, like the one put forward in Carlson’s environmental account, has been rejected by many other authors in the aesthetics of the natural environment. Their critics challenge the idea that only scientific cat- egories can ground the aesthetic appreciation of nature as nature, and they hold that there is not a correct way of appreciating nature. However, they may share with Carlson the idea of correctness under an objectivist paradigm of aesthetic appreciation, according (...) to which correctness means the adequation of the experi- ence to properties of the object. My aim in the article is to claim that it is necessary to endorse an aesthetic standard of correctness that takes into consideration the subjective character of aesthetic appreciation. An aesthetic standard of correct- ness implies universal assent, or validity for everyone in Kantian terms, in place of an objectivist notion. This notion of correctness permits the inclusion of expressive perception of nature as an essential form of aesthetic appreciation. (shrink)

A Logunov, Yu. M Loskutov y M. A Mestvirishvili junto con las introducciones, resúmenes y conclusiones elaborados por el autor de este papel. Esta es una teoría gauge, compatible con las teorías de la física cuántica de las fuerzas electromagnética, débil y fuerte, que define la gravedad como la cuarta (...) fuerza existente en la naturaleza, como campo estático dotada de la partícula transmisora del gravitón virtual de espines 2 y 0, dentro del espíritu del principio de relatividad de Galilei, en su generalización de la relatividad especial de Poincaré que le permitió a los autores la universalización de que las leyes físicas de la naturaleza se cumplen con independencia de los marcos de referencia donde se apliquen. In this paper I consider recent discussions within the representationalist theories of phenomenal consciousness, in particular, the discussions between first order representationalism (FOR) and higher order representationalism (HOR). I aim to show that either there is only a terminological dispute between them or, if the discussion is not simply terminological, then HOR is based on a misunderstanding of the phenomena that a theory of phenomenal consciousness should explain. First, I argue that we can defend first order representationalism from Carruthers' attacks (...) and ignore higher order thoughts in our account of phenomenal consciousness. Then I offer a diagnostic of Carruthers' misunderstanding. In the last section I consider further reasons to include mindreading abilities in an explanation of phenomenal consciousness. (shrink)

Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

Cependant, nous refuserons de suivre la métaphysique modale adoptée par Alvin Plantinga et proposerons une position actualiste, et plus précisément l’essentialisme sérieux prôné par E. J. Lowe. While the Academic sceptics followed the plausible as a criterion of truth and guided their practice by a doxastic norm, so thinking that agential performances are actions for which the agent assumes responsibility, the Pyrrhonists did not accept rational belief-management, dispensing with judgment in empirical matters. In this sense, the Pyrrhonian Sceptic described himself as not acting in any robust sense of the notion, or as ‘acting’ out of sub-personal and social mechanisms. The important point is that the Pyrrhonian advocacy (...) of a minimal conception of ‘belief’ was motivated by ethical concerns: avoiding any sort of commitment, he attempted to preserve his peace of mind. In this article, I argue for a Cartesian model of rational guidance that, in line with some current versions of an agential virtue epistemology, does involve judgment and risk, and thus which is true both to our rational constitution and to our finite and fallible nature. Insofar as epistemic humility is a virtue of rational agents that recognise the limits of their judgments, Pyrrhonian scepticism, and a fortiori any variety of naturalism, is unable to accommodate this virtue. This means that, in contrast to the Cartesian model, the Pyrrhonist does not provide a satisfactory answer to the problem of cognitive disintegration. The Pyrrhonist thus becomes a social rebel, one that violates the norm of serious personal assent that enables the flourishing of a collaborative and social species which depends on agents that, however fallible, are accountable for their actions and judgments. Recent studies demonstrate a moral self effect: continuity in moral values is crucial to ascriptions of identity in and over time. Since Locke, personal identity has been referred to as a ‘forensic’ concept, meaning that it plays a role in attributions of moral responsibility. If moral values are crucial to identity over time, then perceived changes in a person’s set of values may reduce responsibility for past deeds. To test this, we examined the moral self effect in parole contexts. In (...) this empirical article, we conducted two experiments, in which participants were significantly more likely to grant parole to agents who underwent a moral change as opposed to mere behavioral change. The thesis, typical among dualists, that there are no necessitation relations between events of consciousness and physical events implies that it is prima facie lucky that in our world the apparently existing psychophysical laws usually match events of consciousness and physical events in a “harmonious” way. The lucky psychophysical laws argument concludes that typical dualism amounts to a psychophysical parallelism that is prima facie too improbable to be true. I argue that an anthropic reasoning in the space of possible worlds (...) makes the appearance of a harmonious match situation unsurprising, and that this is all that is needed for the argument to be harmless to a typical dualist. Nuestro frenesí de comunicación e información hace que las cosas des- aparezcan y devengan en no-cosas, también llamadas informaciones (Han, 2021: 10). El marco ontológico presente es resultado de un desplazamiento que va del ocaso de las cosas al consumo rápido y frenético de no-cosas. En este entorno intangible el ser humano ya no maneja ninguna cosa. Las no cosas son aquellas cosas puramente intangibles, que no pueden aprehenderse con las manos. Este artículo se propone analizar la reinterpretación del concepto kantiano de crítica como una actitud ética en la obra de Foucault, destacando su relevancia para la hermenéutica crítica contemporánea. Por un lado, se explora cómo la práctica del cuidado de sí se convierte en un medio para “controlar” y “limitar” el poder, permitiendo así el ejercicio constante de la libertad. Esta concepción ética implica una nueva comprensión de la libertad, no como contrapuesta al poder, sino como su antecedente. La reflexión (...) crítica sobre la libertad, la ética y la verdad ofrece la posibilidad de transformarse continuamente a través del trabajo incesante en la construcción y el cultivo de uno mismo. Por otro lado, se presenta un método filosófico crítico basado en la autorreflexión, una ética hermenéutica del cuidado de sí, que abre nuevos horizontes interpretativos para dar forma al yo. Se lleva a cabo un planteamiento del estatus de la naturaleza en el ordenamiento jurídico como sujeto y objeto de derechos. Para lograr este objetivo, los autores se valen de una metodología inductiva a partir de un análisis descriptivo desde la doctrina, jurisprudencia y normas primarias. Con ello, se busca, en primer lugar, responder a la cuestión de si es posible o no que un ordenamiento jurídico contemple derechos de la naturaleza; en segundo lugar, se pretende evidenciar cómo el reconocimiento (...) de derechos sobre la naturaleza por parte de la jurisprudencia en Colombia cuenta con presupuestos comunes pese a que aún no se contemplan reglas claras sobre la asignación de derechos a la naturaleza. Al final, se realiza un llamado de atención para comprender esta figura más como un instrumento que el Estado debe utilizar a favor de la naturaleza, que como un decálogo de derechos. (shrink)

Explorar la posibilidad de una nueva micropolítica crítica del signo a partir de Foucault, inspirada en la genealogía nietzscheana, y examinar las políticas y estrategias de alfabetización mediática e informacional necesarias para desarrollar competencias digitales en la transformación del ecosistema mediático es una tarea fundamental del quehacer filosófico actual. La pregunta por la posibilidad de la verdad retorna en un contexto en el que el pluralismo semiótico y la conducción mediática son dos elementos que rigen y ordenan la sociedad actual, (...) sociedad que se caracteriza por la abundancia de información y la omnipresencia de los medios de comunicación como tecnologías de poder. Desgranar su significado y vínculo nos conduce directamente al estudio del poder y el signo en relación con los efectos de la verdad de la posverdad. En este marco conceptual, la obra de Foucault proporciona herramientas teóricas valiosas para afrontar esta problemática. (shrink)
